A damage waiver is a document the customer signs before renting high-risk gear (jet-ski, motorcycle, skis), accepting use terms, injury risk, and damage liability. Critical for limiting rental-business liability.
A damage waiver (liability waiver) is a legal document where the customer confirms: 1) they've read the equipment use terms, 2) they understand injury/damage risk, 3) they accept liability for damage caused by their fault, 4) they release the rental from liability for certain accident categories (typically: misuse, exceeding guidelines). Standard in: water sports, motorcycles, sports outdoor, event equipment.
Flow: 1) Customer books gear. 2) At pickup (or during online check-in) the waiver text appears. 3) Customer reads + checks 'I've read and accept'. 4) Signs digitally on tablet (or uploads a signature photo). 5) Signed PDF waiver lands in customer's email and in the reservation folder. 6) Without a signed waiver you can't close the handover. Many rentals differentiate by product: jet-ski waiver ≠ kayak waiver (kayak = low risk, short; jet-ski = high risk, several clauses).
Without waiver: an injured customer can claim damages from the rental (injury, death, equipment loss). With waiver: documented risk acceptance limits a large share of such claims. Critical for insurance: without waiver your rental liability policy may not cover incidents. Also a compliance requirement in many jurisdictions (US, UK) for extreme sports.
